The maritime law the case refers to is a federal law not a Californian one. But what do facts matter when the KKK control California. Lol

Yes, it's a Federal Law and they applied in this case, which was their right. But as one of my friends said they may have saved their business but they've destroyed their reputation...

You know I respect you. But in 2013 one of the boats in Truth Aquatics Fleet caught fire at the dock late one evening. Because it was in the harbor when it happened the night officer at the SB Harbor patrol saw the flames and the SB Fire unit was there in minutes but not before it torched the galley and bridge. The cause at that time was attributed to a marine radio charger that overheated and caught fire. What could have prevented, sure they had alarms and smoke detectors but why wasn't some form of fire suppression system installed after that.
I'm not a knee jerk liberal, far from it. But I saw the memorial at the SB Harbor of the people lost and especially the whole family of daughters, mother, and their father and asked why? Knowing that they've had fire before; Why wasn't more done. I'm not he only SB Diver/Surfer/Sailor asking the same questions...

Unrelated in 2005 the Conception was stolen from the SB Harbor and motored all the way to Vandenberg AFB where it was ran aground

all the speculation in the world will not give any of us the answers. we all have to wait for the investigation to finish, then the outrage or not should begin

I don't think you call what they did as filing a lawsuit. They filed for a ruling to limit liability payments. This had to be done before any of the relatives filed their lawsuits. The dive shop in my town said they have used this outfit for 25 years and claims it is the best for dive operations, and never a problem. Just the setup though for sleeping below with no way out needs to be updated though.

There are some reports the dead died of smoke inhalation. Does this show anything about the safety of the boat or cause of the fire. I am no expert so will defer as to whether this is significant at all. The best that come out of it are possibly increased safety precautions in the future.

The RMS Titanic was actually owned by a U.S. citizen.
Although the RMS Titanic was registered as a British ship, it was owned by the American, John Pierpont (J.P.) Morgan, whose company was the controlling trust and retained ownership of the White Star Line. He also owned US Steel, General Electric, as well as the global financial services firm JP Morgan Chase & Co which still thrives today.
When the Titanic sank in 1912, J.P. Morgan, invoked the MMLLA-1851 to limit his liability!
And who knows??? Had the MMLLA-1851 not been enacted, those of us who use Chase bank today might be using BofA or Wells Fargo ...

Although I have never been on an overnight dive boat, I have been on quite a few overnight trips on fishing boats. And on all the overnight boats I've been on, the bunks are below the main deck.
It is HORRIBLE trying to sleep in these bunks!!! But some HX'ers may like sleeping below deck where half the people are snoring so loudly that you might not be able to hear an alarm if one was ringing. And the snoring is not that bad when considering one other thing going on below deck ... THE FARTING!!! There's not a 30 second time gap where someone's blowin' out a fart!! And there's not a minute long gap where half the people below deck are blowin' out farts!!! And on these overnight albacore and/or mahi-mahi fishing trips, I was never able to sleep.
Considering that my farts were the only ones that smelled REALLY GOOD ... it's not a surprise I couldn't sleep. But thankfully there was never a risk of a fire, and freshly caught mahi-mahi is FANTASTIC!!

Apparently by the mid-1800's, ship owners couldn't buy liability insurance, so the congress passed that maritime bill. And it's still on the books today and here we are. Titanic used it as well as oil tanker accidents and the big BP Horizon blow out in the Gulf in 2010.
