So - President gives an unlawful order - he becomes an enemy, domestic, when he goes against the Constitution too.
Biden won the election. Both the popular vote, and the electoral college. And the electoral college confirmed it again today. The only one trying to steal an election is Trump himself, and his repeated coup attempts are already so far over the line the man should be removed from his post and held for trial for his crimes. NO ONE is supposed to be above the law in the USA - especially not Presidents. Trump is NOT Louis XIV - he has no legal right to declare "I am the state!" and his repeated attempts to do so are in and of themselves crimes when he's trying to act on such a ridiculously illegal claim.

It is not true to state that legislatures have the constitutional power to pick another slate of electors after Election Day. So this is NOT going to happen this time.
Larry Lessig, a professor at Harvard Law School and someone who clerked for Antonin Scalia, agued against the idea espoused by some that state legislatures have the constitutional power to pick another state of electors after Election Day.
"Literally never in our history has any state ever done that," Lessig said. "Never has a legislature decided to ignore the vote of the people and pick its own slate."
A "safe harbor" provision of the Electoral Count Act mandates the selection of electors under laws enacted prior to Election Day, according to the National Task Force on Election Crises. The selection process, including any disputes, must be completed at least six days prior to the meeting of electors.
Election Day is established as the “Tuesday after the first Monday in November, in every fourth year succeeding every election of a President and Vice President” in the Constitution. Switching chosen electors once the day has passed is a violation of federal law.
In July, the Supreme Court unanimously ruled states can require members of the Electoral College to vote for the winner of the popular vote. It upheld existing laws in 32 states by doing so, USA TODAY reported.
Lessig said the ruling also sheds light on restrictions placed upon state legislatures.
"For the same reason that electors have no power today, legislatures could not have the power to appoint a slate of electors that was contrary to the vote of the people." Lessig said.

The same could be said about the VP. The issue of duplicate electors would go to the Supreme Court, which would rule positively on states allowing electors to be chosen by popular vote before the VP would have an opportunity to “choose” electors.

The Electoral Count Act of 1887, which Foley calls “astonishingly messy,” could lead to competing interpretations within Congress of what actions it can take on January 6. Foley also notes there are some historical arguments parts of the Electoral Count Act of 1887 that are unconstitutional and there could a role for the Supreme Court to settle these disputes before January 20, 2021, when the Constitution’s 20th Amendment requires the new President to take the oath of office.
"Scholarship both old and new has recognized the inadequacies of the Electoral Count Act in the event that a disputed presidential election reaches the joint session of Congress required by the Twelfth Amendment for the receiving and counting of Electoral College votes from the states,” the group said. “The statute is a morass of ambiguity, which is the exact opposite of what is required in this situation.”
