A suit to establish that the Vice President has discretion over the count, filed against the Vice President, is a walking legal contradiction."
You don't sideline your star quarterback in order to get him to win the game.
Note the premise for the VP's request is not that he does *not* has discretion over the count, but that the suit is illogical.
Pence is in charge and POTUS is his boss.
The 12th amendment does not give any power to US Congress to decide which slate of electors to accept or object. The amendment clearly makes Congress and observing party. Not a participating party

All hail the mighty poon...

When you read the brief, pence states clearly he has no stance averse to the request of the plaintiff, and there is no issue of controversy. He also acknowledges that he HAS POWER the plaintiff seek to promote. He does not deny his power!

learn how to read ...

Short attention span. It is hard to read past the headlines, especially with a top reporting rag like The Hill.

Um, let me put this bluntly for you.... you need to get laid and stay out of politics because you are a member of the uneducated electorate.

@PA970 - you are a walking, moronic contradiction. Why was this suit against Pence brought at all if not to force Pence to take a stand. Gohmert is a strong ally of Trump and it strains credulity that he was not coordinating with Trump's election lawyers - Guiliani, Ellis, Powell. So, in cahoots with Golmert, they decide to bring a worthless lawsuit against Pence for a reason that according to your logic makes absolutely no sense. Hopefully, some of your brain cells will start coming back in 2021. No, ain't gonna happen.

Quat aka squatstopiss with more feelings and idiotic comments. He's the same guy that claimed, without evidence, that Konstantin Kilimnik was a Russian spy/intelligence officer. Trump wins reelection in contingent election.

Trump is also planning a big rally for Jan 6. I remember seeing some old newsreels on the rise of fascism in Germany and Italy. Some parallels in 2021.
Pence is playing the long game. With Trump out and the toxicity he brings he is setting himself up as the front runner for the GOP role, while looking like a competent politician.
For any objection to be sustained, both chambers must agree to it by a simple majority vote. If they do not both agree, the original electoral votes are counted.
Sorry Pence is just there to open the envelopes symbolically lol The Dem controlled house will not have a majority of nays to throw out the electoral votes.
To use a basketball analogy the Republicans are a team fouling to stop the clock in the last minute of a game when their down by 30 points. Just delaying the inevitable lol

Under the 12th Amendment, the vice president, in his constitutionally prescribed role as president of the Senate, is granted the sole power to “open” the electoral vote certificates and “count” them at the joint session of Congress, this year scheduled for Jan. 6. 2. Pence will be faced with dueling electoral votes for the six disputed swing states, a Biden slate from the governors, and a Trump slate from the lawmakers. The six disputed swing states account for 79 electoral votes. Not counting them, Trump stands at 232 and Biden at 227. Thus, the disputed votes are sufficient to make either candidate a winner, if they are counted, or neither candidate a winner, if they are not counted, since in the latter case neither candidate will reach 270 votes (though in that case Trump would have a majority of votes) The 12th Amendment sets forth a procedure for resolving a disputed election where neither candidate achieves a majority of electoral votes. In that case, a “contingent election” is held by the House: “the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote …” Thus, if Pence were to “open” and read the electoral votes cast by both of the competing slates of electors from the six swing states, and choose “not to count” either set—in light of the conflict the House of Representatives would immediately vote to determine the winner, with each state getting one vote. Given that a majority of states are GOP-controlled (although the Democrats control a greater number of representatives), Trump would prevail.”

The alternative electors are not legitimate as their votes where never legally cast in their respective states for Trump. They are mainly symbolic in nature and just leading on this delusion. But I understand delusion runs rampant from reality in the MAGAverse. There's not magical ace up their sleeve to be had. The Senators talking about challenging are only doing it to score points with you Maga types. The only legit chance to overturn anything was through the courts and that all failed Bigly. Suck it up and take the L. Or like most of you said back in 16 Fuck your feelings!!
There are no dueling electors. Only the electors votes are the ones that where legally within each states government chambers not some yolkals casting symbolic Trump elector votes in a GOP headquarters or hotel conference room.
Try not to shut PA down, give him some hope and some rope... it’s fun to see the delusion keep going on and on and what next ludicrous steps the Trumptards may take.
And no, there are no such things as “alternate” electors.
Just like there are no alternate laws of physics.
Just because an alternate slate of pro-Trump electors are presented on Jan 6, they won’t even make it to the VP to have to accept or turn down.
Per NPR.org article, “Congress Role in Election Results: Here’s what happens Jan. 6”
After an objection to elector slate is made, “then the House and Senate retire to own chambers, ..., and members get up to five minutes to speak in favor or against the objection. Then each chamber (Ie House n Senate) will vote, with simple majority required to uphold the objection. BOTH CHAMBERS MUST AGREE TO THE OBJECTION FOR IT TO SUCCEED.”
Democrats control the House and Republicans control the Senate by a hair. The Democratic House certainly won’t vote to support the objection for alternative slate of electors, and its dubious that you’ll have all Republicans in Senate to vote for this while I’m sure all Democrats in Senate wont so it’s doubtful the Senate will have enough votes to support this objection. Nevertheless, for objection to succeed, BOTH chambers must agree, which the House won’t.
I wonder how many on here have actually coughed up money to this Orange Faced maniac. lol
Furthermore crafty Mitch McConnell knows this and probably don’t want to put Republicans in the Senate to have to possibly publicly vote against Trump. That’s why he advised Republicans not to lodge objections on Jan 6. Mitch knows the elector objection is a doomed strategy and will only pit Republicans against a popular exiting President, or appearing to support wild conspiracies against the incoming new President, not to mention the risk/harm it’ll do toward future midterm elections.

PA, time to move on
None of what you're saying is gonna happen
Almost none of the local Republican poll workers that signed off on the election results is gonna go with "widespread voter fraud" when it does not appear to have happened.....at least, there's no proof of it.
I give Donny J credit for making a go of it and creating the largest voter turnout since the early 1900's.......for better or worse, lol
If not for a once in a lifetime pandemic, he probably would've won
But, he didn't

There are at least 3 states that held unconstitutional/unlawful elections. PA, GA, WI and very good cases to be made in MI, AZ and NV. The 6th will be epic. On that day, for Trump, only goods will happen
How where they unlawful elections when they followed rules that where set by Republican legislatures in those States well before the election with regards to mail in voting.
NC accepted mail votes until NOV 12th...But since Trump won NC it was a lawful election huh?
Let’s start checking in on some of the more extreme here after the 6th to make sure that they are healthy.
And keep it coming, PA.
The bullshit you keep believing is astounding and I cannot wait for your dominoes to fall.
In PA and GA election laws changed by bypassing their state legislatures. Clearly unconstitutional. Wisconsin had 221k illegal mail ballots. And if I was so wrong why do u even bother replying to my posts, much less read my posts?

On January 6, the 12th Amendment to the Constitution specifies that the “President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted.” That means that in the case of disputes about competing electoral slates, the President of the Senate—Vice President Pence—would appear to have the ultimate authority to decide which to accept and which to reject. This is supported by 3 U.S. Code § 15. Hence, Trump wins. This is a de facto check on the Electoral College, which few realize because it only happened in 1876.
A Republic, not a Democracy.
If at that point, nobody gets to 270, the 12th Amendment stipulates, “the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote.”

This is needed. Bigly

BREAKING: Rep. Gohmert’s lawsuit against Pence to overturn the election results has been dismissed.

^ post a graph

Please, keep PA hoping for more as the digs himself deeper and more desperate.
Lets see what his response is after this:
Pence, in a 14-page filing brought by Justice Department attorneys, said the suit shouldnt be aimed at him, since he is who Gohmert is trying to empower.
A suit to establish that the Vice President has discretion over the count, filed against the Vice President, is a walking legal contradiction. Its an argument by misguided people who are making fools of Americans. Pences brief said.
I added the link to Pence’s filing above, so you can see the official “fuck you” to the Trumptards from Pence himself.

Everything is fine. The Constitution already gives Pence the power to do what is needed. Pence doesn't need a judges permission to enforce his 12th Amendment rights.
the Electoral Count act contradicts itself. thus, the proper thing would be for pence to refer to the constitution, as federal law cannot override the constitution. the constitution lays out that only PENCE has the right to count the votes. Which was the purpose of the lawsuit. To declare the ECA unconstitutional, which it is. Hence the contradiction comment cuz the suit was basically asking the judge to recite the 12th Amendment. Pence can throw all 7 disputed states electors and no one can do a damn thing
Pence should dismiss the Electoral Count Act outright. That act is what allows objections. Federal statutes do not trump the Constitution. Thus Pence throws out at least 79 electors, no one gets 270(Trump 232-CCP bitch 227) and the election is thrown to the House. The Constitution paves the way
But he is not going to. The link to the legal files I shared shows he will deliver the spear up into your saviors rotting corpse to show he is “politically dead”.

Those links prove nothing. You have a problem comprehending what your sherkunt. Pence about to go Twisted Tea on CCP bitch Biden

You have a problem comprehending what you read sherkunt. Not surprising but expected.

Why do we waste so much money on elections when the Vice President can just choose whomever he wants? Sounds like Democracy to me. The GOP has become the SLP. 0-62 is it? Something around there. Anyways...back to Cobra Kai on Netflix. They need more shows like this.

In case you missed it
Trump bailed on his own superspreader party for people that spent $1,000 each to party maskless with Vanilla Ice and a Beach Boy. I guess Kid Rock was unavailable. Check out the video...watching Kim Guilfoyle "rocking" out to ice ice baby is classic.
Rasmussen, a national conservative pollster is quoting Stalin in order to convince Pence to attempt to overthrow the election. "Those who cast the votes decide nothing. Those who count the votes decide everything" Stalin...
Operation Warp Speed, living up to its name and with the usual Trump attention to detail, is a bit behind schedule> They said they would get 20 million vaccinated before the end of the year and well...they might get one tenth of that. The future forecast looks even better...at current Warp Speed it will take them 10 years to get to where they thought we would be in 6 months. Wait...you mean you cant just tweet something and expect everything to just happen?
Tariffs on alcohol started today. Expected to spend $1 more per bottle. Tariffs .... those things that dont affect the consumers.
The good news is that Trump is about to release his new better cheaper healthcare plan in two weeks. ok, I'm kidding, we all knew....yes even you conservative numbskulls who like to debate knew too...that Trump never had a healthcare plan and he was lying the whole time. Like releasing his tax returns, Mexico paying for the wall, releasing all the damning information that Ghouliani got, etc
The weird celestial event we are all about to witness will be how Trump will go from cult leader to become a pariah over the next year once those electoral votes are certified. There is no way the GOP/SLP will allow Trump to syphon any more money from their donor base to enrich himself and the swamp that he carries around with him.
Happy New Year
Stay safe
perform random acts of kindness

The link is the official response from Pence’s legal team to the suers.
In short, it’s telling them (and you) to go fuck themselves. Pence cannot and will not make changes to established procedure and Trump is done.
He’s a has-been and a loser.

12th Amendment of the Constitution gives Pence full authority on January 6th. He's the law on that day. Pence will Twisted Tea the left bigly
