I know you can sue anyone for any reason. That said, you can file for state disability while you are unable to work. It’s not workers comp so there’s no 3-day penalty and you basically get your full amount of wages. You want to file as soon as you can.

Slip n fall is a very lucrative lawsuit. You have documentation of them being made aware of a hazard. You have documentation of medical treatment... icing on the cake would be if you had a witness.
Just about any of the TV Lawyers will be happy to take your case on a contingency basis, no cost to you unless they settle the claim in your favor. Bet they even find a nice Chiropractor for you.
Give them a call....

Talk to an attorney and if they are willing to take the case on a contingency basis it means they think you have a good case. A consultation should not cost you much if anything at all.

Juice ain’t gonna be worth the squeeze. Heal up & maybe stick to the walkways in the future

Yes
It's called Tort law
You have documentation
Ex
If i have a restaurant and I know the canopy is hang off and it's rod and I know it but fail to fix it
And some1 get hurt
It's tort law
And
Negligence
Look up property law
And I swear
I called Larry h Parker
Told them my thing
They came next day
With paper work
U pay nothing and I had to give them
15 percent of what ever was settled in the claim
So it's free
They are pretty good operationally for getting things done.
They will get u to doctors and etc as well
And u won't pay
And if u don't win u don't pay
They know u will win - u can't b offered to b represented sign unless u are a winner in the case.
A property running as a business has to be
Safe and secure 100%
It's called
Liability
You will be suing their insurance dept
Essentially and also their management company as well for fault. Money will come from their liability insurance and then they will get penalized potentionally dropped from the case
U could have more injuries than u know of as well
Document every day pain
Level 1 to 10
Is it burning- pins n needles sharp
Unable to walk xyz far
Difficulty getting in a car
Loss of wages
All of that stuff
I'm sorry this happened to you
Slum lords

Clutz. Watch where you’re walking 😜

Yay! Sue your current landlord when it's practically impossible to find a rental out there...
Then at the end of your lease, you will get a 30 day notice to move out.
And you'll be back here begging someone for a lead on a place to live.
Risk/reward in a lawsuit for very minor injuries could be more than you've bargained for...
|
|
Larry Parker sounds like an interesting way to go but you're really going to have to prove, or fake, your injuries more than your indicating. Or, lots of lost wages or reduced wages. You're not thoroughly disabled only lost one week's worth of wages. But maybe the lawyers know more than we civilians know. Good luck and feel better quickly. Then again, if you're wrist damage continues and you have a chronic illness because of your fall that would be a good reason to obtain long-term coverage or financial remuneration.

overwatering is hardly = slumlords

Thank you everyone for all the info it is appreciated and for the few who have nasty remarks to make go F yourself. I have never come on here begging for ANYTHING and never will. My injuries are real and don't need to be faked or over played.

I'm no lawyer but when you claim "I can’t work my regular job for a week," do you mean a legit, legal job? Because unless you can tell them what that job is, you can't show how much you're losing in that week.
|

ArabianQueen- Thank you my love I'll pm you now
SonofAdams- I work for Amazon so yes it is legit lol but thanks for being nice to me for once 😋

Just because the doctor said one thing does not mean that is the full extent.
I was hit by someone and both cars totaled. Went to ER and told nothing broken (which was the case) based on shoulder xrays. My brother in law is a chiropractor and told me that it appeared based on my systems that I had a torn rotater cuff and maybe other things. Since he did not do court cases he told me to see someone else. It turned out I did have whiplash. When I told my doctor about what the Chiro said he notated that on my chart (which was good because a chiropractor does not stand up in court as well) and also referred my to Ortho. As it turned out my rotater cuff was torn as shown on the MRI.
The point is just because you go to a doctor does not mean they will catch everything. I thought I was just a little sore and bruised. It took time to realize that I had other issues which the doctors missed. Of course when I saw them at the ER it was immediately after the accident so I was bruised and did not know of my symptoms yet since they were being masked.
My sister in law who is a personal injury lawyer in Oregon was made at me for not consulting her. She was also telling me to see a chiropractor.
The tear is not bad but will need surgery in the future since I can live with it. Of course surgery sometimes works and sometimes doesn't, so I decided to put that off for when I cannot stand it.

Yes. You can sue. You will need documentation. Do you have any photos of the dangerous location where you slipped? Do the best you can with pix especially if the same situation reappears. Are there any other tenants who are aware of the situation you are describing.? Were you able to get pix of your injuries. Go for any Dr. followup if necessary.
Did you document any of your earlier warnings of the unsafe situations in the past. Anything in writing or texts, etc.
|
|
Yes I have pictures of the entire property, where I fell, pictures of my injuries, the complaints I sent in and the doctors report. Other tenants are aware because their children play out there everyday just not sure if anyone else has reported it yet.

Yellow B2 wasn't wrong, although was snarky.
You're complex is most likely owned by an investment group and managed by a property manager. If you win a law suit it's going to look bad for the management team and the investors will take note which may lead them to finding a new management team.
All I'm saying is that you may want to weigh the consequences - if you win a law suit you may put yourself in the cross hairs of management team so when your lease is up they may not want to renew. The investors won't care so much all they care about is getting rent but the management team may.
Just saying.

Atticus Finch I get it but they stopped doing leases like a year ago so how can they kick me out for them not taking care of their property? But thank for the info love 😘🙏🏻

Any cameras?

The more medical attention, visits, surgeries and medicine the better, according to lawyers that I have had to deal with with my injury. If they can't settle big, talking about 10K or more, then it won't be worth the time for them....that is what happened to me.
Just FYI
|
|
Was it your whipping wrist?
I'd be so done if I broke a finger. Theeee finger.
|
|
You probably will deal with the property owners insurance company. Especially if it's slip and fall. The landscape maintenance company is probably at fault for not reducing the amount of watering time as the weather cools. Just document all medical expenses and time lost at work. The last thing they want is dealing with a personal injury lawyer. Good luck...

Also in many cases contacting and discussing the matter with an attorney can help. Consultations are very often free. A good attorney can often settle a case without a lawsuit being filed.
|
|
CoachMia no cameras and it’s my dominate side that’s hurt 🤕 I’ve been keeping a journal of everything that’s happened from the day of the fall. I have a consultation with one of the lawyers in my city tomorrow so fingers crossed that everything goes good.

Larry H Parker will fight for you
|

Those were the first ones that I called and they said unfortunately they don’t specialize in that but they gave me information on a lawyer who does ☺️🙏🏻

Last I checked, when tenants tell landlords about things that need to be fixed in their apartments, they have 2 weeks to comply. I'd assume it applies to common areas like where you fell because of the overabundance of water.
You can use that against them

Allison,
My comment was not meant to be rude. It's simply my take on your situation and the way landlords conduct their business.
I have a friend who wanted to rent a house for his family. 700+ credit score, he and his wife have employment that is with large corporations and very secure. He wrote a 4K/mo full price offer.
He didn't get it. Turns out they had 46 offers in one day, and the offer they took was $800 higher than the asking price.
It's a jungle out there!
I am sorry you took my comment the wrong way.
