Fact 1. Trump had a bunch of shit (documents) that did not belong to him. Original documents belong to the National Archives. (He could probably have copies of a lot of it, as an ex-President.) He was politely asked, repeatedly, to return them all. He wouldn't do it. His lawyers said they were all returned, but that was obviously untrue.

Fact 2. The President has a nearly absolute power to declassify documents WHILE HE IS PRESIDENT. But he has to EXERCISE that right. There is a procedure, and he did not follow it. So, no, the documents were NOT declassified.

He can't just say that while he is on the toilet one day, he whispered to himself, "I hereby declassify all the stuff in the boxes I am taking home to Mar a Lago."

Fact 3. The documents were in a basement protected by nothing more than a padlock, at a facility that Chinese spies have penetrated more than once, that we already know. How hard is it to pick a padlock?

These are all FACTS - not partisan opinions.

Now, here is an opinion - With the carelessness Hillary showed in handling classified stuff, I seriously doubt Trump will ever face any serious charges in this regard. The government just needed to secure the documents, like they asked him a fucking year ago.

If he'd just complied, none of this drama would have been necessary.

So he was punished for doing a lot less than what Trump did. How is this relevant to your argument? Trump also lied about retaining even more classified documents after the government recovered documents from Mar a Lago earlier this year. That is obstruction of justice. And that is a fact.

Trump admitted it on Truth Social yesterday.

A "sitting" president has a lot of authority in classifying or declassifying documents - that is true. However, he does not have the authority to unilaterally declassify anything related to nuclear weapons or anything that originated from a foreign source. And ANY declassification needs to go through a process. Let's assume for a moment that Trump INTENDED to declassify these documents. So here is situation as it stands now:

1) He is not a sitting president so his authority to declassify is no longer valid.

2) The documents taken at Mar-a-Lago were still classified, regardless of Trump's intent because they had not gone through the declassification process. The declassification process culminates with a big black stamp "DECLASSIFIED" stamped right over the red "CLASSIFIED" label. Had the files that were taken been stamped Declassified then the FBI evidence sheet would not have listed them as being Classified, as this constitutes critical evidence for legal proceedings and making a simple mistake like that could compromise the ability to prosecute.

3) Trump is (or was) in possession of Classified documents that he should not have had.

4) The obstruction of justice complaint is rock solid, if they choose to pursue it. However, they may not, just like with Hillary.

5) What Sandy Berger, Hillary Clinton, Barrack Obama, or anyone else has done in the past has nothing to do with what Trump is caught up in now. He screwed up! Plain and simple!

Note: The reference to nuclear materials is speculative at this point. What is not speculative is that at least one file was SCI. That is the top tier of classified information.

“Sec. 1.5. Duration of Classification.

(a) At the time of original classification, the original classification authority shall establish a specific date or event for declassification based on the duration of the national security sensitivity of the information. Upon reaching the date or event, the information shall
be automatically declassified. *Except for information that should clearly and demonstrably be expected to reveal the identity of a confidential human source or a human intelligence source or key design concepts of weapons of mass destruction, the date or event shall not exceed the time frame established in paragraph ( of this section.”

“Sec. 3.1. Authority for Declassification. (a) Information shall be declassified as soon as it no longer meets the standards for classification under this order.
( Information shall be declassified or downgraded by:

(1) the official who authorized the original classification, if that official is still serving in the same position and has original classification authority;
(2) the originator’s current successor in function, if that individual has original classification authority;
(3) a supervisory official of either the originator or his or her successor in function, if the supervisory official has original classification authority; or (4) officials delegated declassification authority in writing by the agency head or the senior agency official of the originating agency.
(c) The Director of National Intelligence (or, if delegated by the Director of National Intelligence, the Principal Deputy Director of National Intelligence) may, with respect to the Intelligence Community, after consultation with the head of the originating Intelligence Community element or department, declassify, downgrade, or direct the declassification or downgrading of information or intelligence relating to intelligence sources, methods, or activities.”

Sec. 3.3 Automatic Declassification.

(a) Subject to paragraphs (–(d) and (g)–(j) of this section, all classified records that (1) are more than 25 years old and (2) have been determined to have permanent historical value under title 44, United States Code, shall be automatically declassified whether or not the records have been reviewed. All classified records shall be automatically declassified on December 31 of the year that is 25 years from the date of origin, except as provided in paragraphs (–(d) and (g)–(j) of this section. If the date of origin of an individual record cannot be readily determined, the date of original classification shall be used instead.
( An agency head may exempt from automatic declassification under paragraph (a) of this section specific information, the release of which should clearly and demonstrably be expected to:

(1) reveal the identity of a confidential human source, a human intelligence source, a relationship with an intelligence or security service of a foreign government or international organization, or a nonhuman intelligence source; or impair the effectiveness of an intelligence method currently in use, available for use, or under development;
(2) reveal information that would assist in the development, production, or use of weapons of mass destruction;
(3) reveal information that would impair U.S. cryptologic systems or activities;
(4) reveal information that would impair the application of state-of-the-art technology within a U.S. weapon system;
(5) reveal formally named or numbered U.S. military war plans that remain in effect, or reveal operational or tactical elements of prior plans that are contained in such active plans;
(6) reveal information, including foreign government information, that would cause serious harm to relations between the United States and a foreign government, or to ongoing diplomatic activities of the United States;
(7) reveal information that would impair the current ability of United States Government officials to protect the President, Vice President, and other protectees for whom protection services, in the interest of the national security, are authorized;
(8) reveal information that would seriously impair current national security emergency preparedness plans or reveal current vulnerabilities of systems, installations, or infrastructures relating to the national security; or
(9) violate a statute, treaty, or international agreement that does not permit the automatic or unilateral declassification of information at 25 years.

Well, to be clear, I am an independent and I did vote for Trump. I thought he might bring a fresh perspective to gridlock that has strangled this country for years. I knew he was a little out there but my hopes for his agenda was high.

What I did not vote for was a King or Despot! What I did not vote for was someone who would trounce on the constitution, attempt a coup, mishandle classified materials, and various and sundry other minor offenses that are his doing. He fucked up - plain and simple! And he appears to be a serial fucked-upper, as the state cases in NY and GA will indicate. You can define Trump in a single word - "Toxic!"

I am not afraid, or embarrassed, to admit that my vote for Trump was a mistake! I can only hope to do better next time. But it most certainly will not be for Trump. I really wish he would do us all a big favor and shut his mouth and go quietly into retirement - in Russia - where they obviously love him!

As far as "obstruction" goes the only thing the Trump legal team would have admitted to is putting a lock on the safe which the FBI had to break into during the raid. I've heard the FBI told Trump to put that lock on back in June.

So that's obstruction?...

Both of those are largely influenced by the war in Ukraine. Putin had been planning on invading Ukraine for a couple of years. I honestly believe that if Trump had won the election that the invasion would have occurred in November, within a couple of weeks of the election. Instead, Biden won and it required Putin to rethink the ramifications of invading Ukraine without a "green light." So clearly, gas prices and inflation are just as much Trump's fault as they are Biden's. The only difference is that Trump probably would have not imposed sanctions so we would not have had a gas crisis (and by extension, as bad an inflation problem).

That is a two part problem: Open southern border - I won't necessarily disagree with that. Illegal substances - we have been fighting that war since the days of Nixon. It is a battle that we will never win! We would probably be better off legalizing it and taxing the shit out of it.

"Debt soaring to new heights" So true. At some time since Reagan, balancing the budget seemed to lose to the concept of 'growth through deficit spending.' And the student loan forgiveness - WOW, why didn't they do something a little less sever like buying the interest portions of those loans to essentially make them interest free loans. That would have been a big political win at a fraction of the cost of total forgiveness. Oh, that's right, it is an election year!

The gas prices and inflation were heading upward FAR earlier than when Putin invaded. Gas was $2.59 a gallon February 2021 (Biden took office January 2021). It was $4.32 a gallon March 2022, a whopping 67% price increase. Putin invaded end of February 2022. So that increase had NOTHING to do with Putin.

Inflation was 1.4% on January 2021. By February 2022, it was 7.9%. NOTHING to do with Putin's invasion at the end of February.

We were nearly energy INDEPENDENT before Joe took office. Now we are begging the Saudi's, Venezuela and even Iran to give us more petroleum, because Joe clearly sent a message to our energy sector, petroleum, you guys are not welcome.

I totally agree we need more renewable sources of energy. Quite honestly, our best option is nuclear, but everyone thinks of nuclear as unsafe. We need to phase in and phase out. Not just tell everyone, you can't buy a gasoline car after 2035. We don't have the charging capability to accomplish that. I'm not sure that I would look to Risch (a lackey Republican) as being the authority on this matter.

But you can put the test of reasonability to the argument: If a file can be declassified, without receiving the "DECLASSIFIED", then how would anyone know if any of the thousands of file were classified or not? "Oh, it's OK, the President said I could show this to you!"

I can tell you this, if you sat down across the table from a reporter and pushed a file towards them that said "Classified" and told them to take a look, they would use a fork to push it back towards you saying, "I'm not putting my fingerprints on that thing. And I don't want to see it!"

The scenario you are proposing, that the President can do as he see fits with classified materials, would create chaos beyond imagination.

And still, we seem to ignore the fact that the powers of the President to do such things does not extend to an ex-president. So, the question arises, when did he declare this material to be declassified? If a tree falls in the forest when no one is around, does it make a sound? So far, no one has come forward saying that they remember Trump declassifying anything! If fact, several of his "team" have stated, without reservation, that he never did that!

Like the NYC con-artist he is, he is spinning a tale designed to obscure the issue so he can get off on a technicality.

You guys can’t logic your way out of that. Politifact is a left leaning “fact checker” and even they confirm what I said is 100% true. The only argument they have is they don’t believe he declassified anything before leaving office, which they can’t prove LoL.

I won't disagree with the fact that a lot of those indicators started upwards before the invasion of Ukraine, but that war definitely was a catalyst for making it worse. And I never said that Biden was a good president -I think he is too old and senile, but that doesn't necessarily mean that every bad thing that has happened since he took office is his fault. A lot of these factors take time to boil until we see the effects of them. No doubt that the major causes of inflation are the supply chain problems that the pandemic caused (and is still causing). And if you want to discuss who was at fault for the pandemic fiasco then I suggest we start a different blog (but Trump is not without blame to some extent).

But when I vote for one man for president and he loses, I don't automatically bash and bad mouth the guy who won. I like to give them a fair chance at doing the right thing. Has Biden done anything worthwhile? Not so sure about that! Will he do anything worthwhile yet? Not so sure about that either, but I can hope. And at this point, that is all we can do until the next presidential election. But until then, this is my country and Biden is our president. He is my president, because I am not a sore loser! So my voice will be heard at the voting booth in 2024 as to whether or not I think he is doing a good job - just the way the Constitution envisioned.

Joe lit the fuse for gas price increase and inflation.

Basically telling our petroleum energy sector that they were no longer welcome in this country started the mess.

You can't ignore the numbers I quoted. We truck everything in our world. So when you raise fuel prices to a level the truckers can't make money, they stop trucking. And then we in CA decide to do away with independent contractors, a totally dumb move. There are nearly 700,000 owner operators in this country, so pricing them out of their business crippled the supply chain.

It was all totally predictable.

If Joe was actually doing what he said he would do. Stop Covid, unite the country, and Build Back Better. I would be cheering. Alas, he has done NONE of that.

^ Which is typical of most politicians - they say anything they think we want to hear to get elected, then do whatever they damn well please once they get into office. "Professional Politicians" are the bane of this country (and probably the problem with every country that allows them to hold onto power at the expense of the people). Time for term limits and a 3rd major political party. That may be the only way to break the gridlock of partisan politics.

Top secret, and anything higher, like the Top Secret / Sensitive Compartmented Information documents found at Mar A Lago, have to be cleared through MDR process (Mandatory Declassification Review) via the Interagency Security Classification Appeals Panel (with current and active clearance) to review that anything unclassified will not hurt current operations, future operations, compromise how intelligence is gathers and stored, and protect past assets who have assisted US intelligence. Absolutely nothing gets a “I said it, so it must be done” at that level of secrecy.

Yep, intelligence. Something you lack.

He moved the Embassy to Jerusalem
He started bolstering and building a wall.
He initiated a tax cut.
He shamed the NATO nations to pay far more than they were paying prior.
He got a Covid vaccine up and running in world record time
Unemployment hit record levels in all demographics
Middle class income actually rose over $6,000 far surpassing the previous administration
Jobless claims hit a record 50 year low.

and the list can go on.....

Jazz51. You obviously do not understand how your country works. And do not understand how the supply chain works either. Lack of truckers did not screw up the supply chain. When the world comes to a halt. And then tries to ramp back up, hence the big problem. With ships sitting out at sea for months. When everything is made in other countries, doesn't take much to screw up the supply chain. Republicans always blame someone else for their shortcomings. Trump is perfect example of that. Own your shit. Be man enough, and stop blaming, illegals, other countries, minorities, everybody but yourself. The president doesn't control gas prices, oil companies and those who produce it do. Maybe stop buying a gas guzzler and u could afford a gallon of gas. Typical American take, take ,take. Wasteful, selfish, and always blaming someone else.

Just to make the point that Trump jeopardized this country's security by storing Top Secret documents and a country club, a Florida woman posed as a Rothschild infiltrated Mar-a-Lago.

Inna Yashchyshyn, 33, allegedly claimed to be Anna de Rothschild of the wealthy European Jewish banking dynasty. The is yet another example that raises concerns about the security of the classified documents at Mar-a-Lago.



Again, stop giving excuses to an idiot. His carelessness alone is a risk to this country, and that's beyond lying that he kept additional confidential documents.
