In its decision Thursday, the Supreme Court not only overturned the 9th Circuit, it a set a new standard for what types of water is covered by the Clean Water Act.
The court's opinion means that the EPA will have the ability to regulate only wetlands with a "continuous surface connection" to a larger body of water in a way that makes them "indistinguishable" from those large bodies.

The EPA after the train derailment in East Palestine Ohio...
"EPA Administrator Michael Regan, who walked along a creek that still reeks of chemicals, sought to reassure skeptical residents that the water is fit for drinking and the air safe to breathe around East Palestine, where just under 5,000 people live near the Pennsylvania state line."
