I think this whole thing is pretty flimsy and it could certainly get ruled either way by SCOTUS but there could be something else, this court could just be done with this guy and being viewed as an extension of MAGA and see this is an off ramp to get rid of him for good. We'll see, it'll be interesting theater.

Here is what the 14th Amendment actually states. I deleted section 2 since it does not apply to this situation. Section one guarantees a person due process of law (read it carefully, as it states No State shall make or enforce any law which shall abridge the privileges of a citizen) and section 3 specifies what these crazy Colorado judges are trying to apply. Section 3 says "shall have engaged in insurrection or rebellion against the United States". Of course, you do realize this was put into the Constitution to address the potential election of Confederates after the Civil War. Until such time as someone proves Trump as engaging in insurrection and he is granted due process....this as Hilary Clinton always says, "is a nothing burger" Trump hasn't even been accused of insurrection and NONE of the January 6th people have been accused of insurrection.
Fourteenth Amendment
Section 1
All persons born or naturalized in the United States, and subject to the jurisdiction thereof, are citizens of the United States and of the State wherein they reside. No State shall make or enforce any law which shall abridge the privileges or immunities of citizens of the United States; nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.
Section 3

I actually agree with you, but it does not specifically say that there has to be a conviction to be disqualified. I'm sure that will be the Trump argument and it does hold water, but will the SCOTUS overturn a State Supreme Court ruling here? We just don't know.

The government cannot take away any privileges of citizens or deprive them of life, liberty or property without due process of law. That means the person faces their accusers and gets to present evidence on their behalf. That has NOT been done.

My point is a modern court is going to argue semantics of something that has not been dealt with since the Civil War. Does section 1 override section 3? Vice versa? Obviously, after the Civil War they did not have time to get a "conviction" of all of the confederates to prevent them from holding office, this is one guy, is the standard the same? I don't think so, but it will be interesting to hear the opinion, especially after Dobb's returned abortion decisions to states.

I could be wildly off base here but I think the reasoning behind SCOTUS overturning the CO supreme court would be that they're using a constitutional amendment to disallow trump from being on the ballot. I think that's not in their purview but rather a decision of constitionalitty should be decided by the supreme court. But again I'm not a lawyer, only have been represented by them lol

It is a win for Trump at this point if he is able to have a substantial delay, but it may actually work out in Jack Smith’s favor in the end. The Colorado case will be combined with other State cases regarding the 14th Amendment. SCOTUS has to take that case. The Court of Appeal will now hear Trump’s appeal, claiming immunity from criminal prosecution, which he will 100% lose. Trump will then appeal once again to the SCOTUS and they may reject hearing it again, automatically confirming the Court of Appeal’s decision.
That way it doesn’t have to decide the case, avoiding the appearance of being heavily embroiled in Trump’s mess.
