"A well regulated Militia, being necessary to the security of a free State, the right of the people to keep and bear Arms, shall not be infringed."
There are many interpretations of this statement, the crafters of this had a perspective that was paying attention to a particular time.
In my view, if any of you are part of the security of a "Free State" AND are part of a "well regulated Militia" this amendment is not necessarily a part of your constitutional right.
The poster just above mentions that we should get to the root of the problem and to study and find out the nature of our culture.
I propose that the study and implementation of the 2nd amendment indeed is the basis of the problem here.
I have two different arguments:
the 3rd amendment is not really applicable in todays society. Yet, it still is on the books. It is most likely because that there is not a huge amount of soldiers who want to quarter in someone's home. And thus, the persons who formed this amendment could not perceive what would be in 247+ years.
With regards to the "Auto and Insurance Regulations", similarly, the persons who did NOT form this amendment could not perceive that this should be something that should be made an amendment.

I'm not a progressive. I am not 100% beholden to politics in California, or really any state, the US, or any country. But I also am a full on believer in the ability for OUR constitution that allows for interpretation or change. Indeed I believe the crafters of the 2nd amendment did have a particular time in mind. A time when the powers that be overreach their given authority. That authority given by the people. With the 2nd amendment being our only last ditch effort to prevent their trampling of our freedom. Also giving us the means to protect one's family and personal property.
California and Newsom are todays version of a time when the crafters foresaw it might come to pass when the citizens needed means to defend itself against tyranny. That's not saying we're going to battle tomorrow, but it allows us to not to be held under the thumb of any government.

The fact of the matter is that until the advent of Scalia SCOTUS historically interpreted the 2nd amendment quite narrowly as applying to state militias for one very good reason. Because that is what it fucking says. Federalist paper #29 defends the 2nd amendment as a buttress of state militias to protect the people from domestic and foreign tyranny. It makes no mention of individual rights to unrestricted gun ownership.
But Scalia stood that understanding on its head and plunged our children into a hellscape of mass butchery. He took it upon himself to decide that the amendment always meant militia and people are the same semantic term in 18th century thought. Despite no historical, linguistic, or documentary evidence to support such a wild claim. Despite the fact that any sober and careful reading of Federalist paper #29 makes it perfectly clear that the 2nd amendment was a protection of the state militias to never be disarmed by the federal government.
Senator Portantino Introduces Bill Requiring Annual Registration of Firearms
Sacramento, CA – Senator Anthony J. Portantino (D – Burbank) introduced SB 1160 today, a measure that would require gun owners to annually register their firearms with the California Department of Justice.
“SB 1160 will give the state better data and help us understand how many firearms are in private hands and who owns them,” stated Senator Portantino. “Currently, we only have rough estimates on how many firearms are in California. This important step toward registration will also increase accountability and responsible gun ownership as we collectively endeavor to increase public safety.”
SB 1160 would require every firearm in the state to be annually registered with the Department of Justice. An annual fee would be deposited into a special fund for the purpose of carrying out the administration and enforcement of the firearm registry. The bill would require the department to establish and maintain a system for the annual registration of firearms and make the registration information available to other law enforcement agencies. SB 1160 also requires that reasonable efforts be made to notify firearms dealers, owners, and the public about registration requirements.
Under SB 1160, registration will not be deemed as evidence that the firearm is lawfully permitted or that the registrant is the lawful owner of the firearm. The measure will prohibit the possession of an unregistered firearm, a violation that would be punishable as an infraction.
“This statue, which requires gun owners to register each firearm annually, is an important tool to remind all citizens of the civic responsibility that comes with owning a firearm. Indeed, the historic roots for this statue trace back to colonial America and serve as a reminder that with ownership comes responsibility,” stated Attorney Brian Hennigan and Loyola Law School Professor Laurie Levenson, who both suggested the bill idea to the Senator.
Senator Portantino has long been a champion of common-sense gun reform policies. During his time in the Assembly, he successfully authorized local governments to prohibit the open carry of handguns and rifles in certain areas and as Senator, he raised the firearm purchase age in California to twenty-one. The Senator has authored legislation related to firearms storage and gun purchase safeguards, as well as a legislation that reduces the number of firearms an unlicensed individual is annually able to sell and the frequency with which they are able to sell. Most recently, he authored legislation aimed at preventing tragic school shootings and a major gun reform measure that offers a new tool to combat the rise in gun violence and save lives – a private right of action. Last year, he partnered with Governor Newsom and Attorney General Bonta to enact SB 2, which implements significant improvements to strengthen California’s existing concealed-carry weapon (CCW) laws
Perhaps we don't have to worry about Government quartering soldiers in our homes because: (1) The Constitution prohibits it; and, (2) the 2nd amendment gives us a way to enforce the 3rd amendment?
Why was this a great concern to the Founding Fathers? Well you see, there was the King over in this place called England who had soldiers here. Those soldiers used to stay wherever they damn well pleased, including your house if they wanted. Oh... and they could also come take your guns if they wanted just to make sure they were safe and night and you couldn't kick them out of your house.
The Founding Fathers fought that King for that and many other reasons. Then these guys were smart enough to know that "Power tends to corrupt, and absolute power corrupts absolutely. Great men are almost always bad men, even when they exercise influence and not authority, still more when you superadd the tendency or the certainty of corruption by authority." So what did they do... they drafted a document to make sure that those freedoms they fought for could never be taken away by a King or the King's subordinates. They did it by separating the power of the Government into three branches and establishing "inalienable rights."

SB1160 and SB2 does absolutely ZERO in taking guns out of the hands that use them to take lives.
SB1160 only makes a way for the state to tax gun holders and an address where they can come and take them. But that was already provided when the buyer purchased it in the first place.
SB2 only attempts to prohibit the carrying of a concealed weapon in areas deemed unlawful. That being most areas except stated in the bill. Of course that was decided by someone who really knows nothing about those who are responsible guns owners in the first place.
Neither of these bills place the focus on taking guns out of criminals hands. But, for the morons out the crimals won't be lining up to register or apply for a ccw.
